Terms and Conditions
Article 1 – Definitions
The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The period during which the customer may exercise the right to cancel the contract.

Consumer: A natural person who is not acting for purposes related to their business or profession and who enters into a distance contract with the business.

Continuous Contract: A distance contract relating to the regular supply of goods or services over a set period.

Right of Withdrawal: The consumer’s legal right to cancel a distance contract within the applicable withdrawal period.

Business: The natural or legal person offering products or services to consumers via distance selling.

Distance Contract: A contract concluded between the business and a consumer using distance communication technologies.

CESOP: The Central Electronic System of Payment Information introduced by the European Union for monitoring payment service providers.

Article 3 – Scope of Application
These General Terms and Conditions apply to all offers made by Melissa & Marie and to all distance contracts concluded between the business and the consumer. Prior to the conclusion of a contract, these terms are made available electronically.
Article 4 – Offers
All offers are non-binding and subject to change. Melissa & Marie reserves the right to modify or withdraw any offer at any time. Each offer clearly states the total price, including any shipping, customs, and handling fees.
Article 5 – The Agreement
A contract is concluded at the moment the consumer accepts the offer and fulfills the stated conditions. Upon completion, Melissa & Marie will send an order confirmation by email without delay.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days of receiving the product, without giving any reason. The customer is responsible for all return shipping costs when exercising the right of withdrawal.
Article 7 – Costs in Case of Withdrawal
If the withdrawal is executed correctly, Melissa & Marie will refund all received payments within 14 days after receiving the returned product in original condition.
Article 8 – Customs, Import Duties & VAT

The customer is solely responsible for complying with all import regulations in their country, including customs duties, taxes, and clearance fees.

Melissa & Marie is not the official importer of record for orders shipped outside the United States.

Any additional charges imposed by postal services, courier companies, or customs authorities are fully the responsibility of the customer.

Necessary shipping documents will be provided, but Melissa & Marie does not guarantee compliance with individual country import regulations.
Article 9 – CESOP Compliance
In accordance with EU regulations effective from 2024, payment service providers may be required to register transaction data in the CESOP system. Melissa & Marie complies with all applicable reporting obligations.
Article 10 – Compliance & Warranty
Jake & Emily guarantees that delivered products comply with the agreement and applicable legal standards. Complaints regarding defects must be submitted in writing within 14 days of receiving the product. Returned items must be unused and in their original packaging.
Article 11 – Delivery
Orders are delivered within 30 days, unless otherwise agreed.
In case of unforeseen delays, the customer will be informed within 14 days after the order is placed.
Orders are shipped in the customer’s name and at their legal risk with regard to import obligations. Failure to comply with customs regulations does not constitute grounds for cancellation or refund.
Article 12 – Complaints
Complaints must be submitted in writing within 7 days after the issue is discovered. Melissa & Marie will respond within 14 days. If a longer handling time is required, the customer will receive an estimated resolution timeframe.
Article 13 – Disputes
These General Terms and Conditions are governed by United States law. Any disputes will first be handled through mutual consultation. If no agreement can be reached, the dispute shall be submitted to the competent court in Austin, Texas, USA.
